I do not know about the enforcement aspect or the legal consequences.

From my perspective. The licensing process was very easy and very quick. The annual costs for the license renewal is about (i think) 120 rand.
If you buy a radio you will have to show that you have a VHF licence.. Only than will (should) the dealer hand you out a radio. The dealer will also program the various channels which are require.

Vratvark 2 is uhf en vhf.

UHF frequencies are typically used for license-free radios. I understand this is because their higher frequency range is more line of sight and as a result these radios are self-limiting w.r.t. transmission distance. As a result they do not pose the issue of cluttering up frequency ranges like VHF & HF radios can do with their greater range.

If you bought a radio with a pre-programmed frequency and never paid for a radio license, you should be safe. Radio suppliers are not allowed to provide you with a radio that's been programmed with frequencies for which you have no license. It will be a quick way for them to go out of business...
